Case No. 2204-01 Right-of-Way Closure/Abandonment

  1. Public hearing on request for Right-of-Way Closure/Abandonment submitted by William Averbach being a 0.315 acre dedicated public roadway measuring 40 feet in width and 343 feet in length, being a part of Farm Lot No. 2, Land Block 239 of the Burton & Danforth Subdivision, recorded in Vol. 1, Pages 62 and 63, Map Records of Aransas County, Texas.
  2. Consider and Act on Ordinance abandoning a 0.315 acre dedicated public roadway measuring 40 feet in width and 343 feet in length, being a part of Farm Lot No. 2, Land Block 239 of the Burton & Danforth Subdivision, recorded in Vol. 1, Pages 62 and 63, Map Records of Aransas County, Texas described as a 25-foot width of the roadway as part of Property #14864 and a 15 foot width of the roadway as part of the Property #14860; as declared by Deed of roadway dedication, defined by metes and bounds, and plat of said closure; and, providing for reversion of said abandoned area to the abutting property owners.

  1. Public hearing on Conditional Use Permit submitted by Crystal Gauthreaux to operate a bar at 402 S. Commercial Street, being Townsite Block 511, Lots 30 through 32, Aransas Pass, Texas, subject to conditions setforth.

EXECUTIVE SESSION.

15.I.

Section 551.074, to deliberate the appointment, employment evaluation, reassignment, duties, discipline or dismissal of a public officer of employee:

Section 551.071 of the Texas Open Meetings Act to meet with its Attorney to seek legal advice on a matter in which the duty of the attorney to the city council under the texas disciplinary rules of professional conduct of the state bar of texas clearly conflicts with the texas open meetings act, and section 551.072 deliberations regarding the real estate property as it relates to a Commercial Contract with 630 Ransom Island Partners, LLC (formerly known as Bluewater Partners, LLC) for unimproved property with an Addendum of Special Provisions for Nueces CAD No. 380310, a 28.61 acres of land on Ransom Island Tr. 7, commonly known as 630 E. Ransom Road, Aransas Pass, Texas 78336.

Reconvene in Open Session to consider and take action, if any, on any item discussed in executive session.

Consider and Act to approve an amendment to the Commercial Contract with 630 Ransom Island Partners, LLC (formerly Bluewater Partners, LLC) granting an extension for unimproved property known as Nueces CAD No. 380310, a 28.61 acres of land on Ransom Island Tract 7, commonly known as 630 E. Ransom Road, Aransas Pass, Texas.

PUBLIC NOTICE is hereby given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda, when authorized by the following provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code:
