Case No. 2202-02

  1. Public hearing on granting renewal of a Conditional Use Permit to Richard Titus and Celia Barnes for one-year to allow a Recreational Vehicle to be placed onto Lots 26 and 27, Block 443, and used as a temporary dwelling for security purposes during construction of a Single-Family Dwelling.
  2.   1. Public hearing on amending the Zoning Ordinance by amending Part III, Section 11, AG, R16, R10, R7A, R7B, D, A1, A2, A3, NS, SC, GB, CA, PD, and MH Zoning Districts, Residential Uses -514 and -610; providing for a repealer clause; and an effective date.

Consider and Act on a donation in the amount of $100 to the Port Aransas Fire Department in honor of Mayor Charles R. Bujan who died on February 9, 2022.

Consider and Act to approve a one-year option with Malynda Williams for Professional Real Estate Broker Services through February 3, 2023.

7.III.

Consider and Act on approving a First Amendment to Conn Brown Harbor Lease Agreement with Captain Cady's and a Temporary Lease for a one-year period beginning March 1, 2022 through March 1, 2023.

Consider, discuss and act on the meeting time for City Council regular meetings.

7.V.

Consider and Act on amending Resolution 2022-1000 ordering the election to held in the City of Aransas Pass on May 7, 2022 by changing the two twelve-hour days of early voting to May 2 and May 3, 2022.

Consider and Act on approving Change Order No. 4 to the contract with JM Davidson for the Conn Brown Harbor Bulkhead in the amount of $789,020.69.

Citizen comments are intended for matters that are not scheduled on the agenda.  Please limit your comments to three minutes and state your name and address for the record.  Be advised that the Texas Open Meetings Act prohibits the City Council from responding and discussing your comments.  The law authorizes the following:

EXECUTIVE SESSION.

15.I.

Section 551.071 of the Texas Open Meeting Act to meet with its Attorney to seek legal advice on a matter in which the duty of the Attorney to the City Council under the Texas Disciplinary Rules of Professional conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act relating to:

  1. Municipal Lien - 1027 S. Lamont, Lots 4 and 5, Block 373
  2. The State of Texas ex. rel. Association Against Annexation Abuse vs. City of Aransas Pass, Texas, Cause No. A-19-0368-CV-C in the 343rd Judicial District Court of Aransas County, Texas

Section 551.071 of the Texas Open Meetings Act to meet with its Attorney to seek legal advice on a matter in which the duty of the attorney to the city council under the texas disciplinary rules of professional conduct of the state bar of texas clearly conflicts with the texas open meetings act, and section 551.072 deliberations regarding the real estate property as it relates to a Commercial Contract with 630 Ransom Island Partners, LLC (formerly known as Bluewater Partners, LLC) for unimproved property with an Addendum of Special Provisions for Nueces CAD No. 380310, a 28.61 acres of land on Ransom Island Tr. 7, commonly known as 630 E. Ransom Road, Aransas Pass, Texas 78336.

Reconvene in Open Session to Consider and Take Action, If any, on any item discussed in executive session.

PUBLIC NOTICE is hereby given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda, when authorized by the following provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code:

  1. Section 551.071, Contemplated or pending litigation or matters where legal advice is requested of the City Attorney.
  2. Section 551.072, The purchase, exchange, lease or value or real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
  3. Section 551.073, A contract for a prospective gift or donation to the city, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
  4. Section 551.074, Personnel matters involving the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee or to hear a complaint against an officer or employee.
