Case No. 2110-12 (Postponed - 12/20/2021)

  1. Public hearing on request submitted by Jerry Kelly for a Conditional Use Permit to allow for a Mixed Land Use (residential and existing sand excavating operation) on W. Gile Avenue, Block 212, Lots 10, 11 and 12, 24.275 Acres, Aransas Pass, Texas, Aransas County Property IDs: 70399, 70400, and 65007.  The property is currently zoned R-7B.
  2. Consider and Act on Ordinance granting a Conditional Use Permit to Jerry Kelly for two years to allow for a Mixed Land Use (residential and existing sand excavation operation) on W. Gile Avenue, with remediation as shown in Exhibits A and B, with Aransas County Property IDs: 70399, 70400 and 65007, Block 212, Lots 10, 11 and 12, 24.275 Acres. The property is currently zoned "R-7B" Single-Family Dwelling District.

Planning Staff Recommendation: Approval, if the Mitigation Plan is met and satisfies the Council.

Planning and Zoning Commission Recommendation: Denial.

Consider and Act on approving Task Order No. 1 to the Professional Services Agreement with K • Friese + Associates for engineering services for the FEMA-HMA grant to perform structural elevations for an amount not to exceed $49,000.

PUBLIC NOTICE is hereby given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda, when authorized by the following provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code:

  1. Section 551.071, Contemplated or pending litigation or matters where legal advice is requested of the City Attorney.
  2. Section 551.072, The purchase, exchange, lease or value or real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
