All of the following items on the Consent Agenda are considered to be routine by the City Council and will be enacted with one motion. Discuss, consider and conduct 2nd Public Hearing for the proposed voluntary annexation of certain property by the city of Aransas Pass, Texas commonly known as 2705 W. Wheeler Avenue, Aransas Pass, Texas 78336, San Patricio County Appraisal District Property ID 1032260 with a legal description of Part of Tract 5, Block 109, T.P. McCampbell 15.0 Acre Subdivision, San Patricio County, Texas, comprised of approximately 8.363 acres as recorded in Volume 1, Page 2, Map Records of Aransas County, Texas; having directed publication and posting of notice of 2nd public hearing for proposed voluntary annexation and directing the City to finalize municipal service plan for the proposed annexed area.

Public hearing on granting a Conditional Use Permit to allow James Andrew to operate a Cabinet and Woodwork Shop at 333 South Commercial Street, being Lot 9, Block 550, Aransas Pass, San Patricio County, Texas, subject to conditions set forth herein.

Consider and Act on Ordinance 2018-4219 amending Ordinance No. 1308, Zoning Ordinance, by amending Part I, Section 4-111 and Part III, Section 11-MH, "MH" Manufactured Home District; providing regulations for Single-Family Lots; providing for a repealer clause and an effective date.

Public hearing on amending to the City of Aransas Pass, Part IV, Section 14 - Creation of a Building Site, amending requirements for Platting Prior to development.

Consider and Act on Ordinance No. 2018-4216 amending City Code of Ordinance, Chapter 13 - Harbors and Waterways; Section 13-12, Discharging of Oils, Waste, Ballast, Rubbish into Turning Basin, Channel or Harbor; and providing an effective date.

Consider and Act on Ordinance No. 2018-4217 amending City Code of Ordinance, Chaper 19.5 - Parks and Recreation, Section 19.5-13, Duties to dispose of catch; and providing an effective date.

Consider and Act on the issuance of a Request for Proposals for lighting repairs at Harbor Point Park.

7.IV.

Consider and Act on Resolution No. 2018-865 of the City of Aransas Pass, Texas authorizing the selection of a Professional Service Provider for the Community Development Block Grant - Disaster Recovery Project.

Consider and Act on Resolution No. 2018-866 of the City of Aransas Pass, Texas authorizing the award of service providers for the Texas Hazard Mitigation Assistance Project funded through the Texas Division of Emergency Management (TDEM) and/or Texas Water Development Board (TWDB).

Consider and Act on Professional Services Agreement with Griffith & Brundrett for Survey of Conn Brown Harbor for a total amount of $20,000.

Consider and Act on approving the renewal of the Defense Logistics Agency Disposition Service (1033 Program) agreement, approving an agreement with the Coastal Bend CAC Multi-Disciplinary Team Enhancement Program (MEP), and an agreement with MHPSS Americares between the Aransas Pass Police Department and Aransas Pass Fire Department and those respective agencies.

EXECUTIVE SESSION.

15.I.

Section 551.087 to receive an update from the San Patricio County Economic Development Corporation regarding economic development matters.

15.II.

Section 551.071 of the Texas Open Meetings Act to meet with its attorney to seek legal advice on a matter in which the duty of the attorney to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act relating to:

  1. Discussion regarding potential City participation in Harbor.
  2. Conn Brown Harbor Lease - Aransas Marine Ways.
  3. Conn Brown Harbor Lease - Aransas Pass Seafood Packers.
  4. City of Aransas Pass vs. J.M. Davidson, Ltd., RLI Insurance Company, and Naismith Engineering, Cause No. S-14-6278CV-C in the 343rd Judicial District Court in San Patricio County, Texas
  5. Collection of Fire Safety Fee.
  6. Fire Department entering into an Agreement for a new Medical Director.
  7. Local Medical Facilities.

Section 551.087 for deliberations regarding economic development negotiations and pursuant to Section 551.071 of the Texas Open Meetings Act to meet with its attorney to seek legal advice on a matter in which the duty of the attorney to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bard of Texas clearly conflicts with the Texas Open Meetings Act relating to economic development negotiations with Hal Jones Development, LLC.

PUBLIC NOTICE is hereby given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda, when authorized by the following provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code:

  1. Section 551.071, Contemplated or pending litigation or matters where legal advise is requested of the City Attorney.
  2. Section 551.072, The purchase, exchange, lease or value or real property, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
  3. Section 551.073, A contract for a prospective gift or donation to the city, if the deliberation in an open meeting would have a detrimental effect on the position of the City in negotiations with a third person.
  4. Section 551.074, personnel matters involving the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee or to hear a complaint against an officer or employee.
